29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training were met (Referenced in 29 CFR 1926.59):    (a) On or about February 11, 2013, and at times prior thereto, there was no written hazard communication program.  Employees used Sherwin Williams A-100 Exterior Acrylic Latex paint 6500-47277.

29 CFR 1910.1200(h)(1) referenced by 29 CFR 1926.59: The employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about was introduced into their work area:    (a) At the project on or about February 11, 2013, and at times prior thereto, employees stated they were not trained on and did not know that the warning label said to wash hands after contact with the paint and to flush the eyes with water immediately after contact with the Sherwin Williams A-100 Exterior Acrylic Latex paint 6500-47277.

29 CFR 1926.50(d)(1): First aid supplies were not easily accessible when required:    (a) At the project on or about February 11, 2013, and at times prior thereto, the first aid supplies were not easily accessible as they were locked inside the building, and no one onsite had access to the building.  A medical facility was located about 10 minutes by car from the project.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and were not so equipped as to enable employees to remove such substances:    (a) At the project on or about February 11, 2013, and at times prior thereto, there was no soap, hand drying towels, or eye wash when employees used Sherwin Williams A-100 Exterior Acrylic Latex paint 6500-47277.  The warning label said to wash hands after contact with the paint and to flush the eyes with water after contact.
