29 CFR 1910.1200(e)(1)(i): The employer did not comply a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet. a) On or about February 11, 2013, at Yager Marine, located at 5001 Hwy 60 E, Owensboro, Ky, in the barge fabrication shop, employees were exposed to hazardous materials (PB Pentrating Spray, Radnir Nozzel Gel, Vitalife Wire Rope Lubricant) covered by the Hazard Communication Standard and the employer did not maintain a list of hazardous materials used on the work site. Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to bodily injury and/or disease, allergic reactions, and various irritations both internal and external. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

This condition exposed employees to injury and illness from acute and/or chronic exposure to chemicals. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1915.51(f)(1): Suitable mechanical ventilation or respiratory protective equipment was not provided for welding, cutting or heating where an unsafe accumulation of contaminants existed. a) On or about April 9, 2013 at Yager Marine located at 5001 HWY 60E, Owensboro, KY in the barge fabrication shop employees were exposed to respirable dust at an 8 hour time weighted average of 6.6 mg/m3 exceeding the permissionable exposure limit (5.0 mg/m3) as established by 29 CFR 1910.1000, Table Z3, while welding steel pieces during the fabrication of a barge brake (confined space) without assessing proper ventilation or having employees wear proper respiratory protection. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1). a) On or about April 9, 2013, at Yager Marine, 5001 HWY 60E, Owensboro, KY, employees were exposed to fall hazards while working on top of a barge that was being fabricated. The top of the barge was approximately 15 feet from the ground. The employer had two strips of caution tape along the front edge of the barge and two employees were standing within 2 feet of the edge using an overhead hoist to move materials without fall protection. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1915.507(b)(1): The portable fire extinguishers and hose systems were not selected, installed, inspected, maintained, and tested by the employer according to NFPA 10-2002 Standard for Portable Fire Extinguishers. a). On or about February 11, 2013, at Yager Marine, located at 5001 Hwy 60 E, Owensboro, KY, in the barge fabrication shop, the employer exposed employees to fire hazards by not having portable fire extinguishers accessible and in posted areas. Fire extinguishers were on the floor behind the wash sink, in a corner behind construction debri, and missing from posted area near main entrance. b) Yager Marine did not inspect and document the monthly inspection of the portable fire extinguisher in the barge fabrication building at the 5001 Hwy 60 E, Ownesboro, KY site. This exposed employees to potential fire hazards. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
