29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    Located along the side and rear area of the building, workers were observed engaged in commercial construction operations digging three trenches. Worker(s) were exposed to potential 7.4 foot cave-in and struck-by hazards in that workers were not properly training in the CFR Subpart P, 1926.650 Excavation requirements.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.651(k)(1):     An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    Located along the side and rear area of the building, workers were observed engaged in commercial construction operations digging three trenches. Worker(s) were exposed to potential 7.4 foot cave-in hazards in that a jobsite inspection by a competent person was not conducted.         In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
