OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while elevated by a rough terrain forklift. (a) Front of Building Service Bays - On or about February 15, 2013 employees were exposed to fall hazards while elevated on a platform extending 30 inches outside the wheelbase of a rough terrain forklift and they were not protected by their employer ensuring that the platform extend no more than 10 inches. (b) Front of Building Service Bays - On or about February 15, 2013 employees were exposed to fall hazards while elevated 12 feet on a platform and they were not protected by a guardrail system with a midrail.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork while the platform was occupied: (a) Front of Building Service Bays - On or about February 15, 2013 employees were exposed to fall hazards while elevated 12 feet above trhe ground and they were not protected by thier employer ensuring that the platform they were standing on was attached to the forks of a rough terrain forklift.
