29 CFR 1926.251(a)(1):  Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment was not removed from service:      When the employer was hoisting cinderblocks the hoist bucket tipped allowing one or more 40 lb cinderblocks to fall four stories, breaking through a wood platform; a construction worker in the basement was struck by a piece of cinderblock.  Rigging deficiencies included:       a)   The hoist bucket was field-made from a rolling debris cart with no way to connect the hoist hook to the top of the bucket for stable support; the hoist chain was wrapped under the bucket resulting that the bucket can tip side to side.        b)   Two of the chain hoist hooks did not have safety latch (keeper latch).  The hook can disconnect from the load if the hoist chain becomes slack.       Location:  24 John Street, New York, N.Y.      On or about 1/9/2013      NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
