OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to accidental operation from unguarded foot pedal: a) Machine Shop - On or about February 25, 2013, the foot control pedal that extends across the bottom of the Kingston engine lathe, is not provided with a guard over the pedal to prevent accidental operation in the event falling or moving objects would contact the pedal. ABATEMENT NOTE: Among others, one feasible and acceptable method of abatement to correct the hazard is to: follow ANSI Standard B11-4, titled "Safety requirements for construction, care, and use of machine tools and lathes;" Section 4.4 Foot Controls, which states "Foot operated controls, if used, shall be protected to prevent accidental operation from falling or moving objects or from someone accidentally stepping on them."
