OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  a) Jobsite: 9530 Rising Sun Avenue, Philadelphia - The employer did not protect employees from death or serious physical harm by developing and implementing adequate methods for two point attachment when operating a chain saw in a tree.  An employee, who was in a tree operating a chain saw with one point of attachment, cut through his single attachment and fell approximately 25 feet to the ground.   The employee sustained serious injuries.  Among other methods, one feasible means of abatement is to comply with the American National Standards Insititute (ANSI) Safety Requirements for Aboricultural Operations, ANSI Z133.1, 2006.  These safety requirements include:   3.l.2 Employers shall instruct their employees in the proper use, inspection, and maintenance of tools and equipment, including ropes and lines, and shall require that appropriate working practices be followed, and   6.3.8 Arborists shall use a second point of attachment (for example, lanyard or doublecrotched climbing line) when operating a chain saw in a tree, unless the employer demonstrates that a greater hazard is posed by using a second point of attachment while operating a chain saw in that particular situation. Using both ends of a two-in-one lanyard shall not be considered two points of attachment when using a chain saw.  ANSI 133.1 defines an arborist as an individual engaged in the profession of arboriculture.
