29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 decibels:   (a) Welding Area - The employer did not establish an effective hearing conservation program in that all the elements of a hearing conservation program did not exist.  Annual audiometric testing and training were not provided.  The employee was exposed to continuous noise at a dose of 74.6% which exceeded the permissible daily noise exposure of 50% (85 dBA) during 398 minutes of personal sampling conducted on April 3, 2013.  The employee's average noise exposure was approximately 87.9 dBA.  Zero exposure was assumed for the unsampled 82 minutes of the employee's shift. The primary health effect of overexposure to noise is hearing loss.     (b) Welding Area - The employer did not establish an effective hearing conservation program in that all the elements of a hearing conservation program did not exist.  Initial audiometric testing and training were not provided, and the employer did not ensure that the employee wore hearing protection for any period exceeding six months after his first exposure until a baseline audiogram was established. The employee was exposed to continuous noise at a dose of 70% which exceeded the permissible daily noise exposure of 50% (85 dBA) during 431 minutes of personal sampling conducted on April 3, 2013.  The employee's average noise exposure was approximately 87.4 dBA.  Zero exposure was assumed for the unsampled 49 minutes of the employee's shift. The primary health effect of overexposure to noise is hearing loss.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
