29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to their work environment to control or eliminate any hazards or other exposure to illness or injury:    a)  Jobsite, 113 Route 73, Voorhees, NJ - Employees making repairs to a light in the facility parking lot did not recognized the unsafe conditions of improperly operating the JLG Model G6-42A Telehandler to lift an employee without fall protection approximately 10-12' above ground; they did not recognize the lift operator walking away from the lift with somebody on an elevated platform as unsafe; they did not recognized the way they were using an unsecured wooden pallet as a scaffold platform as unsafe; they did not recognized not having fall protection as unsafe, they did not recognize the need for head protection, on or about 02/04/13;    b)  Jobsite, 113 Route 73, Voorhees, NJ - Employees making repairs to a light in the facility parking lot were not familiar with the regulations that apply to safely operating the JLG Model G6-42A Telehandler when lifting an employee without fall protection approximately 10-12' above ground; were not familiar with the regulations requiring the lift operator to stay at the controls of the lift while somebody on the elevated platform; were not familiar with the regulations for the proper use of scaffolding; were not familiar with the regulations requiring fall protection when working at heights greater than 10 feet; were not familiar with the regulations requiring head protection, on or about 02/04/13.            NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(c): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer shall retrain each such employee so that the requisite proficiency is regained. Retraining is required in at least the following situations:    a)  Southeast corner of property, parking lot, 113 Route 73, Voorhees, NJ - An employee was working approximately 10-12' above the ground level of an unsecured make shift scaffold (wooden pallet) supported by the forks of the JLG Model G6-42A, on or about 02/04/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.178(l)(4)(ii)(A)-(E): Refresher training in relevant topics had not been be provided to the operator as referenced by the note contained in 1926.602(d):    a)  Southeast corner of property, parking lot, 113 Route 73, Voorhees, NJ - Employees did not recognize the hazards associated with their actions while involved in the repair of a light stanchion, using an all terrain fork lift, JLG Model G6-42A to elevate an employee without any fall protection approximately 10-12' above ground level on an unsecured wooden pallet, on or about 02/04/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:  a)  Southeast Corner of property parking lot, 113 Route 73, Voorhees, NJ - Employee without fall protection was working from an unsecured wooden pallet supported by the forks of the JLG Telehandler Model G6-42A approximately 10-12' above ground level, on or about 02/04/13.
