29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:     On or about March 20, 2013, between address 131 & 144 Frontage Rd., Pecos TX 79772, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions such as no safe means of egress, spoil pile being closer than 2 feet from the edge of excavation and having no adequate protective system(s). Having no competent person for decision making on the regulations applicable to the employee(s) environment to control or eliminate any hazards while working in excavations exposed employees to cave-in, crushed by the soil and/or asphyxia/suffocation hazards.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    On or about March 20, 2013, between address 131 & 144 Frontage Rd., Pecos TX 79772, two employees were observed working in a trench without a safe means of egress. The nearest egress/exit point was approximately 75-feet from employees. The trench was approximately 145-feet long, 11-feet wide, and 7 to 8-feet deep in the middle and 15-feet deep at the end. This condition exposed employees to cave-in hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:     On or about March 20, 2013, between address 131 & 144 Frontage Rd., Pecos TX 79772, two employees were observed working in a trench approximately 145-feet long, 11-feet wide, and 7 to 8-feet deep in the middle and 15-feet deep at the end. Protection was not provided by placing and keeping the spoil pile at least 2 feet from the edge of excavation.  This condition exposed employees to cave-in, crushed by the soil and/or asphyxia/suffocation hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:     On or about March 20, 2013, between address 131 & 144 Frontage Rd., Pecos TX 79772, two employees were observed working in a trench approximately 145-feet long, 11-feet wide, and 7 to 8-feet deep in the middle and 15-feet deep at the end. There was no competent person to check the soil and excavation at the site. No inspection was conducted prior to the start of the shift and a hazard assessment was not performed. This condition exposed employees to cave-in, crushed by the soil and/or asphyxia/suffocation hazards.

Employees in the trench were not protected from cave-ins by an adequate protective system such as a trench box. This condition exposed employees to cave-in, crushed by the soil and/or asphyxia/suffocation hazards.
