29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)  (i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:        a) Arii Construction and Maintenance Operations: On April 8, 2013 and at times prior thereto, workers used dust mask (N95), half-mask cartridge type respirators and full-face respirator without a written respirator program that includes procedures for selection, fit testing, training, cleaning, disinfecting and storage of respirators.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:       On April 8, 2013 and at times prior thereto, the employer failed to provide medical evaluations to workers using tight fitting respirators. The lack of a medical/physical evaluation can result to respiratory illness, asphyxiation and chemical intoxication.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:   Arii Construction and Maintenance Operations: On April 8, 2013 and at times prior thereto, employer allows the workers to use dust mask (N95) when sanding, grinding and painting without providing the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134.
