29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceeded the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    On or about April 17, 2013, and at times prior thereto and thereafter, in the fabrication shop, the employer did not develop and implement a representative monitoring program to determine the necessity for a hearing conservation program, for employees using ear plugs while grinding and cutting.  Peak sound level readings reached 107.4 dBA, exposing employees to the hazards of noise.
