29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladderâ¿¿s length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    At the side fronting Marine Corps Drive, on or about April 18, 2013, an aluminum extension ladder used to access the roof did not extend at least 3 feet  above the landing surface. The top of the ledge was about twelve feet above the ground.  Employee accessed the ladder to inspect roof tiles.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.   Near the entrance to Dennys Restaurant, Tamuning on or about April 18, 2013, skin protection (gloves) were not worn while an employee brushed on Behr exterior satin enamel paint onto the exterior of building.  The warning label on the container stated; Avoid contact with eyes and skin.
