29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.   At the front of the store on May 14, 2013, scaffold components were used by employees to ascend and descend from the mobile scaffold. A portable ladder or similar means of access was not provided.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:Note:  When employees are using stilts, the top edge height of the top rail, or equivalent member, shall be increased an amount equal to the height of the stilts.  At the front of the store on May 14, 2013, the top edge height of top rails was not positioned 42 inches (1.1m) plus or minus 3 inches above the walking/working level. The height of the toprail was approximately 37 inches from the working level.

At the front of the store on May 14, 2013, midrails were not installed between the top edge of the guardrail system and the walking/working surface at the south and east sides of the mobile scaffold.

29 CFR 1926.502(d)(15): Anchorage points used for attachment of personal fall arrest equipment were not  independent of any anchorage point being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee.  At the front of the store on May 14, 2013, employees attached snaphooks onto the mobile scaffold end frames and utilized the frames as anchorage devices. The end frames were not designed to support at least 5,000 pounds per employee attached.
