29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On or about May 31, 2013 at the above addressed jobsite, an employee painting was not protected from from a fall of approximately thirty feet, thereby exposing the employee to the hazards associated with falls. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: a. On or about May 31, 2013, at the above addressed jobsite, an employee was elevated in a job made wooden box attached to the forks of a JLG rough terrain forklift. The manufacturer prohibits elevating personal in this manner, thereby exposing the employee to fall hazards. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
