29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:    (a)  DRB Construction at 1974 W 35th Ave, Denver, CO 80211:  On June 6, 2013 the exposing employer did not ensure that employees were protected from injury, in that one employee using a pneumatic nail gun and hammer was working near and at the edge on the second level of the north east corner of the building and was not utilizing a fall protection system. The employee was wearing a fall harness; however, the lanyard was not connected to his harness. This condition exposed the employee to a fall hazard of approximately 9 feet to the lower level and 18 feet to ground level.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee who might be exposed to fall hazards:    (a)  DRB Construction at 1974 W 35th Ave, Denver, CO 80211:  On June 6, 2013 the exposing employer did not ensure that each employee engaged in roofing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection. An employee using a pneumatic nail gun and hammer was working near and at the edge on the second level of the north east corner of the building and was not utilizing a fall protection system. The employee was wearing a fall harness; however, the lanyard was not connected to his harness. This condition exposed the employee to a fall hazard of approximately 9 feet to the lower level and 18 feet to ground level.     Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a)     The nature of fall hazards in the work area; b)     The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)     The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)     The role of each employee in the safety monitoring system when this system is used; e)     The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)      The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)     The role of employees in fall protection plans; h)     The standards contained in this subpart.
