29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    (a) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where an Arboga Radial Arm Drill, Model No. ER830, Serial No. 279257 was operated in the maintenance shop without chuck or chip guards at 17885 Highway 13, Wahpeton, North Dakota.      (b) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by hazards where a shop built, 48 inch, 2,000 psi H-Frame hydraulic press was operated in the maintenance shop without barrier guarding at 17885 Highway 13, Wahpeton, North Dakota.      (c) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a three spindled Leland Gifford, No. 2 Drill and Tap machine was operated in the fabrication area without chuck or chip guards at 17885 Highway 13, Wahpeton, North Dakota.      (d) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a Rockwell Drill press, model no. EF1-3T, serial no. 27007-03 was operated in the R&D Building without chuck or chip guards at 17885 Highway 13, Wahpeton, North Dakota.      (e) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a Jet Radial Arm Drill and Tap machine, model no. JRD-700, serial no. 15414, was operated in the R&D Building without chuck or chip guards at 17885 Highway 13, Wahpeton, North Dakota.      (f) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where an Arboga Maskiner Radial Arm Drill and Tap machine, serial no. 150247 was operated in the R&D Building without chuck or chip guards at 17885 Highway 13, Wahpeton, North Dakota.      (g) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a Powermatic Drill Press, model no. 1200, serial no. 0-1328-1 was operated in the R&D Building without  chuck or chip guards at 17885 Highway 13, Wahpeton, North Dakota.

Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or caught-in hazards:    (a) On or about July 18, 2013 and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards while operating a HAAS CNC machine, model no. VF5, machine no. 155 without a functioning interlock door devise at 17885 Highway 13, Wahpeton, North Dakota.    Note: Wil-Rich LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard Section (5)(a)(1), which was contained in OSHA inspection number 313589665, Citation  1, Item 1, and was affirmed as a final order on September 4, 2009, with respect to a workplace located at 17885 Highway 13, Wahpeton, North Dakota.      Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be to install a functioning door interlock device on the HAAS CNC machine in accordance with ANSI B11.22 Safety Requirements for Turning Centers Automatic Numerically Controlled Turning Machines, paragraphs 6.21 Safeguarding and 6.21.2 Automatic Mode which states:      1. Paragraph 6.21: Machine shall be safeguarded whenever practical by fixed or interlocked movable guards.      2. Paragraph 6.21.1.2: Machine operation shall only be possible when the guards are closed and the safeguarding (protective) devices are active. If it is possible, in this mode, to open an interlocked moveable guard, the hazardous movement shall cease and be inhibited. If opening of the interlocked movable guard gives access to hazards, guard locking shall be provided.
