29 CFR 1910.134(e)(6)(i): The employer did not obtain from the physician or other licensed health care professional (PLHCP)  a written recommendation regarding the employee's ability to use the respirator:  (a)  Med-Van, Inc., Non- Emergency Transportation-   The employer did not obtain a written recommendation regarding employees ability to use respirators from the physician or other licensed health care professional for employees required to wear 3M, N95, Health Care Particulate respirators. Employees are required to wear respiratory protection during cardio pulmonary resuscitation (CPR) and for protection against tuberculosis (confirmed or suspected).

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  (a) Med-Van, Inc., Non- Emergency Transportation-  Two employees required to wear a tight fitting facepiece respirator (N95) were not fit tested prior to the initial use of the respirator. The company could not produce fit test records for the two employees. One employee had been fit tested and the company had his fit test record.
