Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being struck-by and/or crushed-by suspended load:     This violation was discovered on July 23, 2013, where employees were exposed to struck-by and/or crushed-by hazards while operating an electric overhead chain hoist with a lifter/clamp attached. The lifter/clamp did not have the rated load legibly marked on its main structure or on a tag attached to its main structure where it was visible.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4):      The employer did not establish a program consisting of energy control procedures and employee training. This violation was discovered on July 23, 2013, where employees in the maintenance department who perform service and maintenance work on equipment and/or machinery was not provided procedures for the control of hazardous energy.

Additional inspections were not performed during sling use, where service conditions warrant. Damaged or defective slings were not immediately removed from service:  This violation was observed on July 23, 2013, in the material handling area located at 2910 W. Erwin Street, Tyler, Texas 75702; where employees used a nylon sling that was damaged.
