29 CFR 1926.1060(a)(1)(v): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the standards contained in Subpart X: Employees had not been trained on the proper use of portable ladders. Multiple hazards involving the set-up and usage of the ladder on site were identified during the inspection. These hazards and the lack of training exposed the employees to a fall hazards in excess of 9 feet to the asphalt on this site.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Workers were observed re-roofing the roof of a residential style construction site (house) while wearing harness but not being connected to any lanyard or ropes and some workers were not wearing any form of fall protection at all. The workers were exposed to falls of over 9 feet to sidewalk, dirt and stones below. Ernesto Castrejon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 311469134, citation number 1, item number 1, issued on November 24, 2009 and became a Final Order effective December 16, 2009, with respect to a workplace located at 20002 Dewey Ave. Omaha, NE.

This training would allow each employee to recognize the hazards of falling and allow them to understand the proper procedures to be followed in order to minimize these hazards. The employees are exposed to a fall from heights of greater than 9 feet to asphalt below.
