29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a) Demolition of the Steel Tank at the Rear Area of the Site, Clay: Two employees were exposed to head injury form falling or flying objects while performing a demolition operation on a steel tank.  The employees were not wearing protective helmets, as observed on August 26, 2013.        (b) Water Treatment Plant worksite, Clay: An employee was working around an operating excavator exposed to moving or flying objects.  The employee was not wearing a protective helmet, as determined on August 26, 2013.

29 CFR 1910.1200(e)(1): (This requirement is applicable to construction work as referenced by 29 CFR 1926.59) The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:       (a) Water Treatment Plant worksite, Clay: Employees were exposed to hazardous materials such as Sherwin Williams catalyzed epoxy paint, compressed oxygen, and acetylene while working on the job site.  The written hazard communication program was not maintained, in that the Sherwin William paint, oxygen, and acetylene were not included on the list of hazardous material and the material safety data sheets for those items were not available, as determined on August 26, 2013.     ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
