OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to: combustible dust explosion, deflagration, or other fire hazards while working at or near the hammer mill and dust collection system which were protected by a Flamex brand spark detection and extinguishing system: a) On or about 9/3/13 throughout the facility; employer did not inspection and maintain the spark detection and extinguishing system installed in January 2001 to protect against and minimize the effects of a combustible dust explosion, deflagration, or flash fire in the main air line from the hammer mills and bucket elevators to the meal bin back to the bag house, as described in the Flamex Inc. , General Installation and Applications Manual, January 2001 provided to the employer during the installation of the extinguishing system.
