OSH ACT of 1970 Section (5)(a)(1):   The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to: combustible dust explosion, deflagration, or other fire hazards while working at or near the hammer mill and dust collection system which were protected by a Flamex brand spark detection and extinguishing system:   a) On or about 9/3/13 throughout the facility; employer did not inspection and maintain the spark detection and extinguishing system installed in January 2001 to protect against and minimize the effects of a combustible dust explosion, deflagration, or flash fire in the main air line from the hammer mills and bucket elevators to the meal bin back to the bag house, as described in the Flamex Inc. , General Installation and Applications Manual, January 2001 provided to the employer during the installation of the extinguishing system. 29 CFR 1910.332(b)(1): Employees were not trained in and familiar with the safety-related work practices required by 1910.331 through 1910.335 that pertained to their respective job assignments:   a) On or about 9/3/12 in the Shop area; employees involved in checking voltages, replacing fuses and resetting heaters inside the electrical panels in proximity to 480 volts AC were not trained on the hazards of contacting electrical current, proper protective equipment and other protective measures. 29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   a) On or about 09/03/13 throughout the shop; employer was using a powered industrial truck, Linde brand ( model H25T- 03, serial # 351H07170225 ) equipped with a lifting attachment to lift conveyor parts and other equipment in the shop, without an approval from the manufacturer exposing employees to struck by hazards.
