29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. On or about September 12, 2013 and times prior thereto, employees were exposed to fall hazards of greater than four feet from the balcony at the front of the Faith Tank building. Guard rails were not in place on the open sides of the balcony. The height from the floor of the balcony to the surface below was measured at approximately 88 1/2 inches.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about September 11, 2013 and times prior thereto a makeshift device was fashioned and used to mimic the human action of depressing and holding the roller start button on the control for the "big bending rollers". By allowing the rollers to operate without the operator maintaining contact on the run button the point of operation protection for the operator is defeated.
