OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with Light Amplification by Stimulated Emission of Radiation (LASER) marking operation on poles in the Framing Shed on or about November 14, 2013 and prior thereto. One feasible means of abatement would be implementation of a laser safety program as described in the American National Standard for Safe Use of Lasers Z136.1. Among other items, this would include the following: 1) Designating a laser safety officer to oversee safety for all operating, maintenance and servicing situations; 2) Training employees regarding the hazards of laser light exposure; 3) Calculating a nominal hazard zone for the laser; 4) Establish a Class IV Laser controlled area using the information from the calculations of the nominal hazard zone.

29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment: On or about November 14, 2013, an employee operating a classifying saw was exposed to an 8 hour time weighted average sound level of 92.8 dBA and an employee operating the peeler was exposed to an 8 hour time weighted average sound level of 87.2 dBA. The employer had not implemented a hearing conservation program that included audiometric testing and training. Employees were exposed to the hazard of not identifying loss of hearing.

Employees were not using personal protective equipment that included a full body harness, lanyard and anchor point. b. On or about November 14, 2013 and prior thereto, employees standing and walking on top of poles stacked on buggies to place and remove skids and place and remove chains were exposed to the hazard of falls from elelvation. Employees were not using personal protective equipment that included a full body harness, lanyard and anchor point. Or in the alternative OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards in the following instances: a. On or about November 14, 2013 and prior thereto, employees using skids extending from between poles to climb to the top of the stack of poles on buggies were exposed to the hazard of falls from elevation. b. On or about November 14, 2013 and prior thereto, employees standing and walking on top of poles stacked on buggies to place and remove skids and place and remove chains were exposed to the hazard of falls from elevation. Among other methods,feasible and acceptable means of abatement would be to require the use of a personal fall arrest system and install an anchor point for employees to attach a lanyard or perform the job from a stationary or mobile work platform with guardrails.
