29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training were met (Referenced in 29 CFR 1926.59):  In the women's restroom next to the Juicy Couture store on or about October 31, 2013, and at times prior thereto, there was no written hazard communication program available. Employees used DAP Brilliant White Caulk and DAP Quick Seal Plus to install plumbing fixtures.

(This provision is applicable to construction employment by 29 CFR 1926.59.):   In the women's restroom next to the Juicy Couture store on or about October 31, 2013, and at times prior thereto, there were no material safety data sheets available. Employees used DAP Brilliant White Caulk and DAP Quick Seal Plus to install plumbing fixtures.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  In the womens restroom next to the Juicy Couture store on or about October 31, 2013, and at times prior thereto , the employer did not provide employees with effective information and training for the chemicals they used. Employees that used DAP Brilliant White Caulk and DAP Quick Seal Plus to install plumbing fixtures did not know the first aid procedures to use in the event of exposure or the personal protective equipment needed to prevent or minimize exposure.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and were not so equipped as to enable employees to remove such substances:  In the womens restroom next to the Juicy Couture store on or about October 31, 2013, the employer did not provide employees with adequate washing facilities as there was no eye wash available or hoses connected to the faucets to wash the eyes for 15 minutes. Employees used DAP Brilliant White Caulk and DAP Quick Seal Plus to install plumbing fixtures. The material safety data sheets for the products require the eyes be washed for 15 minutes in the event of exposure.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:  In the womens restroom next to the Juicy Couture store on or about October 31, 2013, eye protection was not worn by employees that used DAP Brilliant White Caulk and DAP Quick Seal Plus to install plumbing fixtures. The material safety data sheets for the products state the goggles or safety glasses with side shields for eye protection.
