29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired:   At the project on or about October 31, 2013, a ten foot long step ladder was not marked or tagged as defective and not to use or withdrawn from service. The ten foot ladder spread bars consisted of two 1 by 2s screwed into the ladders legs and the metal support brackets were broken on the ladders bottom rung. Employees used the ladder to access the scaffold platform.
