29 CFR 1926.20(b)(3): The use of any machinery, tool, material, or equipment which was not in compliance with any applicable requirement of this part was not prohibited. Such machine, tool, material, or equipment was not either identified as unsafe by tagging or locking the controls to render them inoperable or by physically removed from its place of operation:   At the project on or about November 6, 2013, a damaged extension cord that powered a 110 VAC Makita nipper was not identified as unsafe with a tag, by rendering inoperative or by physically removing it from the site. The nipper was used to cut the steel panels.

29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that was reasonably accessible in terms of time and distance to the worksite, which was available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not be available at the worksite to render first aid:   At the project on or about November 6, 2013, and at times prior thereto, no one had first aid training and the nearest medical facility was more than four minutes away. Employees used a scissors lift to access a 15 foot high canopy, nippers and drills.

29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors:   At the project on or about November 6, 2013, there was no assured equipment grounding conductor program or ground fault circuit interrupters to protect employee that used a 110 VAC Makita nipper to cut steel panels. The nipper was powered through an extension cord that was plugged into an exterior outlet on the gas station. The outlet had no ground fault circuit-interrupter protection.

29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables shall be protected from damage:   In the driveway and parking area of the project on or about November 6, 2013, a 110 VAC extension cord was not protected from damage as it lay on the concrete and asphalt and was run over by vehicles.
