29 CFR 1926.250(b)(1): Material inside a building(s) under construction was stored within 10 feet of an exterior wall(s) which did not extend above the top of the material being stored:    a) 2nd Floor North Side of the Building - Drywall scrap, pallets and metal framing were observed being stored near the edge of thebuilding exposing workers below to struck by hazards, on or about 10/30/13.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.    a) 2nd Floor, North Side of the Building - A laborer was observed without adequate fall protection while collecting scrap framing exposing him to a 20 foot fall hazard, on or about 10/30/13.     This contractor is the second level contractor for the site. They are the controlling and correcting employer for the exposed sub-contractor. The foreman stated he is continuously monitoring and directing the sub-contractors operations. The foreman stated in his interview that he was aware of the operations in progress. Therefore, this contractor is being cited Under the Multi-Employer Workplace Policy
