29 CFR 1903.19(d)(1): The employer did not submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required: (a) Marshall Plumbing & Backhoe Service, Inc., failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1, for hazards associated with: 1) the owner and a laborer working in an unprotected 7'9" deep excavation and neither receiving training on the hazards associated with such work or on the OSHA standards 29 CFR 1926.651 and 652; 2) a laborer working in an unprotected 7'9" deep excavation without wearing a hard hat and 3) employees were not protected from cave-ins by adequate protective system.
