29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:   In the rear of the building on or about November 18, 2013, face shields, aprons and rubber gloves were not worn while handling and filling the batteries with water.  The batteries were for a Skyjack scissors lift.

29 CFR 1926.441(a)(5) : Face shields, aprons, and rubber gloves were not provided for workers handling acids or batteries:  In the rear of the building on or about November 18, 2013, face shields, aprons and rubber gloves were not provided for employees that handled and filled batteries with water.  The batteries were for a Skyjack scissors lift.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  In the rear of the building on or about November 18, 2013, there was no fall protection for a 6 foot opening in the guardrails on the mezzanine.  There was barricade tape across the opening.  It was 11 feet, 2 inches from the mezzanine to the concrete floor below.  Employees were on the mezzanine to test the sprinkler system for leaks and had to walk near the opening to access the work area.
