29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift:     a)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, vicinity of buildings 1200 & 1300 - Employee without proper fall protection was repositioning the JLG Model 600S aerial lift in and around the buildings, on or about 11/15/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(c): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer had not retrained each such employee so that the requisite proficiency is regained.     Note: Retraining is required in at least the following situations: 1926.454(c)(3)Where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency.     a)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, vicinity of buildings 1200 & 1300 - Employee operating the JLG Model 600S had not received any training or retraining in the requirements to always use fall restraint or arrest equipment when working from aerial lifts, on or about 11/19/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(c): When the employer had reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer did not retrain each such employee:     Note: Circumstances where retraining is required include, but are not limited to, situations where: 1926.503(c)(3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.    a)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, building 1400 - Employee without fall protection was exposed to an approximate 33 foot while marking out the work area on top of building, on or about 11/15/13;    b)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, vicinity of buildings 1500 & 1700 - Employees of the company's subcontractors without fall protection were exposed to falls from approximately 6 feet up to approximately 33 feet, on or about 11/19/13;    c)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, vicinity of building 1500 - Employees of the company's subcontractors without fall protection were exposed to falls from approximately 6 feet up to approximately 22 feet, on or about 12/13/13. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:      a)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, vicinity of building 1400 - Employee without fall protection exposed to a fall of approximately 33 feet while marking out the roof for one of his subcontractors, on or about 11/15/13;    b)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, vicinity of buildings 1500 & 1700 - Employees of the company's subcontractors without fall protection were exposed to falls from approximately 6 feet up to approximately 33 feet, on or about 11/19/13;    c)    Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, vicinity of building 1500 - Employees of the company's subcontractors without fall protection were exposed to falls from approximately 6 feet up to approximately 22 feet, on or about 12/13/13.    Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    Lowther's Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314676446, citation number 01, item number 001 and was affirmed as a final order on 05/13/2011, with respect to a workplace located at Block 7505, Lot 15, Paterson, NJ.     Lowther's Contracting LLC was also previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 315153056, citation number 01, item number 003 and was affirmed as a final order on 12/26/2011, with respect to a workplace located at 1276 Glassboro Road, Williamstown, NJ.
