29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The Employer failed to provide documentation and certification for abatement of citation 1 item 1 in which an employee without proper fall protection was working from the JLG aerial lift at heights up to approximately 31 feet. Condition observed on or about 11/19/13.  b) The employer failed to provide documentation and certification for abatement of citation 1 item 2 in which employees had not been trained or retrained in the requirements in the proper use of fall protection in accordance with the OSHA standards when working from aerial lifts. Condition observed on or about 11/19/13.  c) The employer failed to provide documentation and certification for abatement of citation 1 item 3 in which employees had not been trained or retrained in the requirements in the proper use of fall protection in accordance with the OSHA standards; employees were exposed to falls up to approximately 10 to 30 feet. Condition observed on or about 11/19/13.  d) The employer failed to provide documentation and certification for abatement of citation 1 item 4 in which a 28 foot extension used by the employee to access the approximate 11 foot high open sided floor only extended approximately 2 feet above the point being accessed. Condition observed on or about 11/19/13.  e) The employer failed to provide documentation and certification for abatement of citation 1 item 5 in which an employee carried out a 4 foot x 8 foot sheet of plywood overhead up the 32 foot aluminum extension ladder and then attached it to the stud wall. Condition observed on or about 11/19/13.  f) The employer failed to provide documentation and certification for abatement of citation 1 item 6 in which employees had not been trained or retrained in the requirements to use their ladders in accordance with the OSHA standards. Condition observed on or about 11/19/13.  g) The employer failed to provide abatement and certification for abatement of citation 2 item 1 in which employees without proper fall protection was working on a roof at an edge exposed to an approximate 11 to 30 foot fall to the ground. Condition observed on or about 11/19/13.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift:  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a)     Barclay Glen Apartments, 1000 Fawn Dr, Williamstown, NJ, between buildings 1300 & 1400 - Employee without proper fall protection was working from the JLG aerial lift at heights up to approximately 31 feet, on or about 11/19/13. Express Construction 3 Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 313984148, citation number 1, item number 4, and was affirmed as a final order on 03/23/11, with respect to a workplace located at 122 Victory Road, Springfield, NJ 07081.
