Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of being struck by the unexpected collapse of storage racks. On or about November 27, 2013, and at times prior thereto, employees were exposed to being struck-by and /or crushed by storage racks while walking in and around areas such as, but not limited to, the warehouse area that had unanchored and free standing storage racks. Among other methods, one feasible and acceptable method to correct the hazards noted is to follow the American National Standards Institute (ANSI) standard MH16.1:2012(a revision of MH16.1-2008): Specifications for the Design, Testing and Utilization of Industrial Steel Storage Racks, which includes the following: Section 1.4.7 Column Base Plates and Anchors: The bottom of all columns shall be furnished with column base plates, as specified in 7.1. All rack columns shall be anchored to the floor with anchor bolts, which shall be designed in accordance with Section 7.3, to resist all applicable forces as described in Section 2.1 or Section 2.2 DISCLAIMER: a) The employer is not limited to the abatement method(s) suggested by OSHA. b) The employer is responsible for selecting and implementing an effective abatement method.

29 CFR 1910.157(c)(1): Portable fire extinguishers were not mounted, located, and identified so that they were readily accessible without subjecting the employees to injuries. On or about 11/27/2013, at the NE corner of the warehouse a clear space was not kept around the ABC portable fire extingisher as a result of a 35 gallon trash dispenser and a work cart.
