OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards while operating an overhead, and underhung hoist: a) Welding Department: On or about March 26, 2026, and at times prior, the employer did not ensure that repairs to the Budgit 3 ton Electric Chain Hoist were conducted or taken out of service and promptly repaired before resuming normal operations when the crane was operated with broken hook throat latches. This condition exposed employees to struck-by and crushing hazards. b) Welding Department: On or about March 26, 2026, and at times prior, the employer did not ensure that repairs to the ACCO Wright Way 1 ton Electric Chain Hoist were conducted or taken out of service and promptly repaired before resuming normal operations when the crane was operated with broken hook throat latches. This condition exposed employees to struck-by and crushing hazards. c) Welding Department: On or about March 26, 2026, and at times prior, did not ensure the Budgit 3 ton Electric Chain and the ACCO Wright Way 1 ton Electric Chain Hoist were visually inspected frequently and periodically. This condition exposed employees to struck-by and crushing hazards.
