Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to fires and explosions from an oil treating process: a) No evaluation was made of the materials used in construction for the hydrogenation process, to determine if the steel is of acceptable thickness and material for piping and vessels. b) The overpressure protection system and the A,B,C and D heaters, were not designed so as to safely relieve to prevent vessel failure in the event of overpressure.
