29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail,  was not provided to assist employees in mounting and dismounting the ladder:      location: unit c-1  on or about: 12/2/13      a) An employee was using an 8 ft. Werner A-frame ladder to access the top plate. The ladder did not reach the top plate level.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    Location: unit c-1  On or about: 12/2/13    a) An employee was standing on the top plate of the 1st floor wall, while placing the 2nd floor joist.  The employees was not provided with fall protection. The employee was exposed to a fall of 9 feet 7  inches.    Mendez Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 579218, citation number 1, item number 1 and was affirmed as a final order on 3/8/13, with respect to a workplace located at 20 Orchard Drive  Tarrytown, NY 10591.
