OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards potentially created by the large amounts of southern yellow pine logs being stored in the open at the site, and having to be cut to size with chain saws. Other fire hazards include log handling equipment containing flammable fuels and lubricants, fuel cans containing gasoline and/or diesel, and lightning strikes; yet the employer did not provide portable fire extinguishers at the worksite, or any other firefighting means. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to obtain and maintain an adequate number of fire extinguishers at the site. a) Veteran's Terminal Worksite: The employer had not provided portable fire extinguishers for an area in which potential fire hazards existed. ABATEMENT CERTIFICATION IS REQUIRED.
