OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards potentially created by the large amounts of southern yellow pine logs being stored in the open at the site, and having to be cut to size with chain saws. Other fire hazards include log handling equipment containing flammable fuels and lubricants, fuel cans containing gasoline and/or diesel, and lightning strikes; yet the employer did not provide portable fire extinguishers at the worksite, or any other firefighting means.  Among other methods, one feasible and acceptable method to correct this hazard is for the employer to obtain and maintain an adequate number of fire extinguishers at the site.    a) Veteran's Terminal Worksite: The employer had not provided portable fire extinguishers for an area in which potential fire hazards existed.   ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1917.127(a)(1): The employer did not provide accessible washing and toilet facilities sufficient for the sanitary requirements of employees, in that, the facilities did not have: (i) running water of any kind ; (iv) functioning fixed or portable toilets in separate compartments with latch-equipped doors.  a) Veterans Terminal worksite: There was no running water at the worksite for employees to wash up, and although the office trailer  was equipped with a toilet and a sink, neither were hooked up to a water supply rendering them non- functioning. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   a) Workplace: The employer could not produce a written hazard communication program at the site, which covered hazards used by employees at the site such as motor oil, gasoline, and Rust-Oleum solvent spray paint. There were also no MSDS on site, no list of hazardous chemicals, nor had all employees been trained on the hazards used at the worksite.   ABATEMENT CERTIFICATION IS REQUIRED
