At the BP gas station work site, an employee had accessed the top of the canopy from the scaffold which was greater than 14 inches from the canopy, and the scaffold deck was greater than 24 inches below the canopy, thereby exposing employees to a fall hazard of 12 to 15 feet.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.    a. At the BP gas station work site, the employer had set up a mobile scaffold with integrated ladder, however the base support was raised to high resulting in a break in elevation from the ground to the first rung of the ladder being approximately 32 inches. The employees were exposed to a fall hazard of 32 inches.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.    a. On January 15, 2013, employees working at the BP in Coshocton were working on the ground without head protection under a mobile scaffold while an employee worked from the scaffold and another employee worked on the canopy for the gas station. Employees were exposed to a struckby hazard.      Burnett Enterprises was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 387542, citation number 1, item number 1 and was affirmed as a final order on May 10, 2013, with respect to a workplace located at 965 Poplar Street Nelsonville, OH 45764.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.    a. At the BP gas station work site, the employer was using a mobile scaffold which did not have a guardrail system in the front of the scaffold facing the work, thereby exposing the employee to a fall hazard of approximately 12 feet.    b. At the BP gas station work site, the employer was using a mobile scaffold which did not have mid rails on the ends of the platform thereby not meeting the criteria of a guardrail system. The employees were exposed to a fall hazard of approximately 12 feet.    Burnett Enterprises was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 387542, citation number 1, item number 2/b and was affirmed as a final order on May 10, 2013, with respect to a workplace located at 965 Poplar Street Nelsonville, OH 45764.

At the BP gas station work site, the employer was riding on a mobile scaffold that was approximately 12 feet in height and a width of four feet, resulting in a three to one ratio; thereby exposing employees to a fall hazard of 12 feet.    Burnett Enterprises was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.452(w)(6)(v), which was contained in OSHA inspection number 387542, citation number 1, item number 2c and was affirmed as a final order on May 10, 2013, with respect to a workplace located at 965 poplar Street Nelsonville, OH 45764.
