29 CFR 1910.134(d)(1)(i): The employer did not select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker is exposed:     LOCATION: Cashman/Weeks NB JV Jobsite:     Employees were provided with Miller LPR-100 half mask respirators, with hepa filters, which do not provide protection against the products of decomposition generated when employees were torch cutting coated steel pilings; which included phosgene, oxides of nitrogen, benezene and toluene.

29 CFR 1926.354(c)(2): Employee(s) were not protected by a respirator, in accordance with the requirements of 29 CFR 1926 Subpart E, when welding, cutting or heating toxic preservative coatings in open air.  Location: Cashman Weeks NB, JV:  Employees exposed to decomposition products including but not limited to, phosgene, oxides of nitrogen, benzene, toluene, carbon monoxide and halogenated compounds, were wearing Hepa filter half face respirators which do not provide protection against gasses and organic vapors.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace, including a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form:     LOCATION: Cashman/Weeks NB, JV:         An actual estimate of employee exposures, to the products of decomposition of Americoat 240 Black Resin, created when employees torch cut and burnt thru this coating while cutting a groove in the tongue of piling sheets, was not identified and evaluated.
