29 CFR 1926.34(c): Means of egress was not continually maintained free of all obstructions or impediments to full instant use in the case of fire or other emergency.     a) On or about 2/13/14 at former church being renovated into apartments at 400 Lincoln Pkwy., Buffalo, NY: Employees used passageways in the lower level to move to different areas and as a pathway to exits.  In three places, this path went through wall openings. The height of those openings were 58 inches or less and employees could walk right into the wall if there was an emergency and they had to exit the building.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.405(b)(1): Unused openings in cabinets, boxes, and fittings were not effectively closed:    a) On or about 2/13/14 in lower level apt.# 10, at former church being renovated into apartments at 400 Lincoln Pkwy., Buffalo, NY:  A metal 2-receptacle 120 volt-ac outlet box was supported only by Romex cable coming out of a breaker box. Electrical equipment and an extension cord were plugged into each receptacle on the box. A circular "knock-out" opening was not covered.    NO ABATEMENT CERTIFICATION REQUIRED

The stairway was enclosed on both sides and a handrail was not installed on at least one side.    NO ABATEMENT CERTIFICATION REQUIRED

The stairway had four risers and was not enclosed on either side. No stairrail system was present on each side.    NO ABATEMENT CERTIFICATION REQUIRED
