29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.           Throughout the facility - During the period of August 18, 2013 through February 18, 2014, employees required to operate powered industrial vehicles were involved in accidents (dropped loads) or near misses. The employer did not provide the operators refresher training as required by 1910.178.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.    Throughout the facility - On or about February 18, 2014, employees were required to operate powered industrial vehicles. The employer was not able to provide certification that each PIV operator had been trained and evaluated.

29 CFR 1904.29(a): Basic requirement. You must use OSHA 300, 300-A, and 301 forms, or equivalent forms, for recordable injuries and illnesses. The OSHA 300 form is called the Log of Work-Related Injuries and Illnesses, the 300-A is the Summary of Work-Related Injuries and Illnesses, and the OSHA 301 form is called the Injury and Illness Incident Report.    Recordkeeping - On or about February 18, 2014, the employer did not maintain OSHA logs, OSHA summaries, or OSHA 301 forms for 2011, 2012, 2013, and 2014.
