29 CFR 1910.107(e)(9):  Flammable liquids for use in spraying operations were transferred from one container to another without both containers being effectively bonded and grounded to prevent discharge sparks of static electricity.    On or about February 21, 2014 and times prior thereto, employees of MBM Enterprises used flammable liquids to include but not limited to primer and xylene in the paint shop of the employer's facility located at or near 50 Transport Lane in Pleasant Plains, Arkansas.  Xylene was transferred from a 55 gallon drum to another container without being effectively bonded and grounded to prevent discharge sparks of static electricity, exposing the employees to fire hazards.

29 CFR 1910.178(l)(1)(ii): 29 CFR 1910.178(l)(1)(ii):  The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:    On or about February 21, 2014 and times prior thereto, employees of MBM Enterprises, Inc. operated a Lull rough terrain forklift with model number 944E-42 and serial number 590678RA in the yard of the employer's facility located at or near 50 Transport Lane in Pleasant Plains, Arkansas.  The employer had not ensured that each employee had completed the required training before allowing to operate the rough terrain forklift, exposing employees to tip-over, caught-in, crushed-by, and roll over hazards.

On or about February 21, 2014 and times prior thereto, employees of MBM Enterprises, Inc. used chemicals to include but not limited to xylene, primer, paints, and lubricants for the manufacture of steel beams for steel erection at the employer's facility located at or near 50 Transport Lane in Pleasant Plains, Arkansas.  The employer had not trained employees on the new label elements and safety data sheets for chemicals used.

The employer did not have material safety data sheets available for the red oxide primer manufactured by Performance Coatings (PMI) and used by employees for spray painting operations.

29 CFR 1910.305(a)(2)(ix): All lamps for general illumination were not protected from accidental contact or breakage by a suitable fixture or lampholder with a guard. Brass shell, paper-lined sockets, or other metal-cased sockets may not be used unless the shell is grounded.   On or about February 21, 2014 and times prior thereto, employees of MBM Enterprises, Inc. operated an ironworker manufactured by Geka for the manufacture of steel beams for steel erection at the employer's facility located at or near 50 Transport Lane in Pleasant Plains, Arkansas.  A lamp fixture was observed installed on the machine for general illumination and the lampholder was not guarded to protect the live bulb from accidental contact.
