Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that his employees were exposed to fall hazards:  This violation was observed on or about February 24, 2014, where at least two (2) employees, who were tree trimming, used the top cap and top step of fiberglass stepladders, and were exposed to falls of approximately 8 feet to the ground below.

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:  This violation was observed on or about February 24, 2014, where at least one employee who was standing on and working from limbs while pruning a tree, was not protected from fall more than 8-feet to the lower level.

This violation was observed on or about February 24, 2014, where at least one (1) employee, who was standing below employees trimming a tree and exposed to falling objects, was not protected from head injuries by wearing a hard hat.
