29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  a) The employer did not ensure that each employee in an excavation was protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section.  This violation occurred when employees were allowed to work inside a 4 foot 6 inch deep trench that had signs of sloughing, indicative of a possible cave-in, without any protective system.
