OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees may struck by a passing vehicle.   (a)  North State Street and Mississippi Street - On or March 7, 2014 five employees were exposed to a struck by hazard while working in a roadway without high-visibility apparel.  Employees were exposed to vehicular traffic while walking and standing directly in this roadway.

29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  (a) Job Site - On or about March 7, 2014 the employer had not developed a written hazard communication program.  Employees were handling a herbicide, Killzall II Super Concentrate Weed Killer.
