29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  On or about 03/19/14, at the Clay Road Apartments, located on 2299 Brighton Henrietta Town Line Road, in Henrietta, New York, an employee engaged in roof work was exposed to falling 30 feet to ground level without fall protection.  The employer did not/could not demonstrate that the use of conventional fall protection methods is/are infeasible or creates a greater hazard.    NO ABATEMENT CERTIFICATION REQURIED

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:   (a)   On or about 03/19/14, at the Clay Road Apartments, located on 2299 Brighton Henrietta Town Line Road, in Henrietta, New York, an employee was not provided with an intermediate step or ramp to access a work area to cut framing studs, where the access point was greater than 19 inches.  (23 inches measured)   NO ABATEMENT CERTIFICATION REQUIRED
