29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:        a) On or about 4/01/14, on concrete deck of Marcy Casino, 199 Lincoln Pkwy., Buffalo, NY:  A Milwaukee Hole Shooter Drill, model # 1660-1 with a mixer attachment, was used to mix mortar. The drill was connected to 120-volt ac power via an extension cord. The plug on the cord of the drill lacked a grounding prong.          NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:      a) On or about 4/01/14, on concrete deck of Marcy Casino, 199 Lincoln Pkwy., Buffalo, NY:  Three employees were exposed to a potential fall of approx. 15 ft. while patching holes in the concrete deck.  No guardrails or other fall protection system was utilized to protect the employees.        NO ABATEMENT CERTIFICATION REQUIRED
