29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   a) The employer failed to provide documentation and certification for abatement of Citation 1 item 1 in which frequent and regular inspections were not conducted by a competent person, exposing employees to fall hazards on or about 04/14/14.  b) The employer failed to provide documentation and certification for abatement of Citation 1 item 2 in which employees working from the basket of a JLG 1250AJP Boom Lift were not protected from falls by the use of a fall restraint system. on or about 04/14/2014.  c) The employer failed to provide documentation and certification for abatement of Citation 1 item 3a in which the employer did not ensure that each employee performing stucco work was protected from falling. Employees were exposed to falls of more than 25ft. On or about 04/14/2014.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  a) Renaissance on the Ocean, 1 Riviera Drive, Building 1, Long Branch, NJ 07740: On or about October 24, 2013, employees working from the basket of a JLG 1250AJP Boom Lift were not protected from falls by the use of a fall restraint system.    Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
