OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm including severe burns and explosions from accumulated saw dust in and around ignition sources without the dust collection system connected and functional. a)Main saw electrical boxes: Employees were exposed to fire and explosion hazards due to accumulated wood dust over 3 inches deep, with a KsT value of 22.13 bar meters per second on top of electrical boxes of the main saw that had opening in the box.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Pointing Saw: On or about April 24th, 2014 an employee was exposed to noise levels at the hearing conservation level of 68.86 % (equivalent to an 8 hour time weighted average TWA of 87.28 dBA) which is 1.37 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating one of two pointing saws. The sampling period was for 6 hours and 43 minute with the remainder of the 8 hour shift given a 0 db for the 8 hour Time Weighted Average calculation.
