29 CFR 1910.212(a)(1):  Point(s) or operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):    (a)Erker Grain Company, LLC at 113 Ensign St., Fort Morgan, CO 80701:  The conveyor at the sewing machine was missing part of the plastic guard over the end leaving an exposed in-going nip point between the belt and the roller. This condition exposed the employees to an amputation hazard.

29 CFR  1910.272(g)(1)(iii): The atmosphere within a bin, silo, tank, and other grain storage structure in the grain handling facility was not tested for oxygen content prior to employee entry:    (a)Erker Grain Company, LLC at 113 Ensign St., Fort Morgan, CO 80701:  The employer did not ensure the atmosphere within the silos were tested for oxygen content when those silos had been classified as a permit required confined spaces.  This condition exposed the employee to hazards associated with an oxygen deficient atmosphere in permit required confined spaces.

This condition exposed the employees to hazards due to the lack of rescue operations suited for this bin.

29 CFR 1910.272(j)(1):  The employer did not develop and implement a written housekeeping program that establishes the frequency and method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces:  (a)Erker Grain Company, LLC at 113 Ensign St., Fort Morgan, CO 80701:  The employer did not fully implement the written housekeeping program in that dust accumulations in the facility, specifically when looking down into and below the scale area from the "Texas House" and the bottom of legs 2 and 3.   This condition could lead to respiratory hazards to the employees.
